Waivers

INDIAN NATIONS YOUTH SPORTS - TERMS & CONDITIONS:

By checking the box below, I the registrant and/or legal guardian of the registrant am legally agreeing to all terms and conditions set forth by Indian Nations Youth Sports and the individual club and/or organization in which I am registering.

I am agreeing that I am at least 18 years of age and the legal guardian of the person/persons registering hereof. I further agree that any information provided in the following pages is truthful and accurate to the best of my knowledge.

I also state that any falsification of documents, illicit or immoral activities will be punished pursuant to the by-laws of the proper governing authorities, and that such activity will lead to penalties including: no reimbursement of funds and partial or permanent expulsion from the affiliation/organization I am applying for.

Right to Refuse Service

By accepting the terms of membership in the Indian Nations Youth Sports (INYS) programs I acknowledge that the INYS is a private organization and that it reserves the right to refuse membership and/or participation to any person whose actions hinder the activities of the INYS and that such determination will be at the sole discretion of Indian Nations Youth Sports.

Arbitration

IT IS AGREED THAT ANY MATTER IN DISPUTE BETWEEN YOU AND INDIAN NATIONS YOUTH SPORTS SHALL BE SUBJECT TO ARBITRATION AS AN ALTERNATIVE TO COURT ACTION PURSUANT TO THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION, A COPY OF WHICH IS AVAILABLE ON REQUEST FROM THE COMPANY. ANY DECISION REACHED BY ARBITRATION SHALL BE BINDING UPON BOTH YOU AND THE COMPANY. THE ARBITRATION AWARD MAY INCLUDE ATTORNEY'S FEES IF ALLOWED BY STATE LAW AND MAY BE ENTERED AS A JUDGEMENT IN ANY COURT OF PROPER JURISDICTION.

Attorney's fees

The Parties agree that if Indian Nations Youth Sports prevails in any litigation or arbitration brought arising from any dispute, then INYS shall be entitled to recover all costs, expenses and attorney’s fees associated therewith.

PARTICIPATION AUTHORIZATION AND RELEASE OF LIABILITY:

For himself/herself and for his/her spouse and for his/her child and other children hereby represents and agrees to the following:
My child has my permission to participate in all sponsored or endorsed activities. The Association and its Board Members and Directors, Officers, Coaches, Coaching Staffs, agents and licensees are hereby released from any and all liability or responsibility for any injury that may occur to my child, to me, to my spouse and any of my other children resulting directly or indirectly from my child's participation in activities including, but not necessarily limited to, league tournaments, practice games, practices, transportation to and from games and tournaments or otherwise and the use of practice facilities, games facilities, concession facilities or any other facility.

AUTHORIZATION FOR EMERGENCY TREATMENT

In the event of a medical emergency, I hereby authorize my child to be transported to the nearest emergency room or medical facility. I also authorize officials to secure the use of an ambulance for transporting my child to the hospital and/or to administer first aid treatment as necessary. I further authorize any physician, surgeon or dentist of the nearest emergency medical center to administer any emergency treatment procedure or medicine necessary or advisable, when accompanied by an adult. I further agree to pay the hospital, doctors and ambulance fees for all services rendered to the above named child. I request that this authorization remain in force from this date until the end of the calendar year unless notified in writing of a change by me.

RULES AND REGULATIONS CONTRACT:

I have read the Rules and Regulations and Code of Ethics, of which I have a copy, as stated by the Board of Directors. I hereby agree to abide by said rules and regulations. I have also read and fully understand the penalties prescribed for violation or non-compliance of said rules and regulations and by checking the box do agree to these terms and conditions.

WYFA Parents/Guardians Code of Ethics

I hereby pledge to provide positive support, care, and encouragement for my child participating in youth sports by following this Parent’s Code of Ethics:
I will encourage good sportsmanship by demonstrating positive support for all players, coaches,and officials at every game, practice or other youth sports event.
I will place the emotional and physical well being of my child ahead of my personal desire to win.
I will insist that my child play in a safe and healthy environment.
I will require that my child’s coach be trained in the responsibilities of being a youth sports coach and that the coach upholds the Coaches’ Code of Ethics.
I will support coaches and officials working with my child in order to encourage a positive and enjoyable experience for all.
I will demand a sports environment for my child that is free from drugs, tobacco, and alcohol and will refrain from their use at all youth sports events.
I will remember that the game is for youth- not adults.
I will do my very best to make youth sports fun for my child.
I will ask my child to treat other players, coaches, fans, and officials with respect regardless of race, sex creed, or ability.
I will help my child enjoy the youth sports experience by doing whatever I can, such as being a respectful fan, assisting with coaching, or providing transportation.
I will read the National Standards For Youth Sports and do what I can to help all youth sports organizations and enforce them.

WYFA Rules and Regulations

We would like to welcome you to the WYFA. Our youth football association plays under the Indian Nation Football Conference and gate fees at all games will be as followed: Adults $3.00, Students (6-18) $1.00, Seniors 65> $1.00 Children 5, are free. All WYFA Football players and Cheerleaders will get in free if they are in uniform. Half of the games will be held out of town and it will be your responsibility as a parent/guardian to get your child to the game.

1. Before participating in any camps, practices or games, you must do the following:
A. Fill out, in full and sign all necessary forms regarding your child required by WYFA.
B. All fees and deposits paid in full to WYFA. Registration fees are non-refundable. All returned checks to WYFA will result in a $20.00 fee.

2. If you and your child choose to make use of WYFA’s scholarship cards/fundraisers to reduce the cost of the entry fee, then you as parents/guardians are responsible for the merchandise and/or money. It must be picked up and returned by the deigned time place specified by the WYFA Board of Directors. The WYFA Board of Directors will specify the fundraiser or fundraisers.

3. In order to hold registration fees and deposits to a minimum, parents will be asked to volunteer to work admission gates, concession stands,
stadium clean ups, field set ups, chain crews, etc. Failure to comply will result in suspension of offending person and/or participant.

4. Parents/guardians are required to attend child’s games and pratices. This is not only to ensure the safety of your child, but also to instill him/her
with confidence, support and enthusiasm. Parents will be required to sign a parent code of ethics.

5. All equipment issued is the sole property of WYFA except for game jersey. All uniforms and equipment must be returned to the WYFA office
in good condition within 5 days of last game of the season. If your son/daughter discontinues active participation in WYFA, their uniform and
equipment must be returned within 5 days of discontinuance. You shall be charged and be required to pay a rental fee of $5.00 per day the
uniform and equipment is delinquent or the replacement cost of $250.00 for such uniform and equipment at the election of the WYFA. In the
event an attorney is used in the attempt to obtain the return of the uniform and/or equipment rental charges or replacement costs, then you shall
also be liable for reasonable attorney’s fees, cost of litigation and reasonable expenses.

6. Practices shall be at specified times, designated by the head coach of your team and upon approval of the Board of Directors. Parents must have their child/children to practices and games on or before the designated time and shall pick up their child/children immediately after such practices or games. Mighty Mites will have no more than three practices per week, limited to 1 ½ hours maximum per practice. 3rd and 4th grade will have no more than three practices per week, limited to two hours maximum per practice. 5th and 6th grade will have no more than four practices per week, limited to two hours maximum per practice. Participants are expected to attend all practices and the last practice before a game is mandatory. Failure to abide by this rule may result in sanctions or discipline being imposed on the participant including extra duties performed or sitting out of the game that week. The WYFA Board of Directors must approve any variance of this rule.

7. Parents, relatives or visitors are not allowed on the sidelines or playing field during a game. A coach, official or WYFA director may waive this
rule only for the purpose of carrying out a specified duty.

8. WYFA is for our YOUTH and as such, WYFA cannot and will not permit profanity, abusive language, unsportsmanlike conduct, alcohol, drug
use or any other conduct of a manner which could be deemed offensive. This rules applies to all participants, parents, guardians, and guest. This rule shall apply at all practices as well as all games and WYFA sponsored events.

9. If you incur a grievance, you will need to first discuss the matter with your coach. If not resolved, you should communicate your field coordinator.
If then not resolved, you should present in writing your grievance to the WYFA Board of Directors.

10. Football is team sports and requires team effort. The coach will have the authority to discipline a player during practice for reasons felt necessary by the coach to maintain order and control of the participants. The coach or coaches may elect to eject a player from the
field of practice or to sit on the sidelines as a disciplinary measure. If the player is not summoned to return to practice, this shall be called a
absence. If a player has 50% or more in absences in one week this may result in the sitting out of the game for that week.

11. If WYFA has an end of season party, players must have completed ALL season and post-season tournaments in order to participate. If the player
does not finish out the season, he/she will NOT be allowed to participate in the end of season party.

12. A voting member of WYFA must have paid their membership fee of $5.00 prior to Sept. 15th of each year.

13. The infraction of a rule or regulation by a participant, parent, guardian or their guest at a game or practice, shall be dealt with by the WYFA Board of Directors and may result in action taken against such offender in one or more of the following:
a. Verbal or written reprimand
b. Banning said offender from a game or games.
c. A fine imposed for each offense committed by said offender being a maximum of $200.00 for each offense.
d. The removal of an offender or offenders from any and all functions of WYFA for a period of time deemed appropriate by the WYFA Board of Directors.
e. Any other such action as the WYFA Board of Directors may deem appropriate.

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of being allowed to participate on behalf of the Wagoner Youth Football Association program and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Impulse Lacrosse their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

Registration Confirmation

You have now officially signed your player up for Football. Payment will not be taken until two weeks prior to the season, which is before the Combine on July 18th. Please do not try to pay online. This will prevent a mass refund should the season have to be canceled. You will be able to pay registration starting July 8th. We will issue scholarship cards on July 8th at the WYFA office. Your player will then have two weeks to sell. Your player must be signed up and paid by July 18th to attend combine, or paid and signed up by July 22nd to play in the 2020 season.

Equipment will be issued out from July 8th to August 3rd to players that have completed the payments of the registration fees. If the office is open and you make your final payment for the registration, equipment may be able to be sized and received at that moment. We believe that this would be more convenient for you. If not then we will have other dates for equipment sizing.

Practices can start August 3rd. Once practices start, there will be no refunds of registration, due to already purchasing jerseys, insurance fees, football equipment, helmets cleaned, club fees, team fees and registration fees. We want you to know before you sign up that if for whatever reason the season would be cancel, the refund policy is the same, no refund after the first practice. unlike other sports football has all it expenses up front. If, we get just the scrimmages in before it is cancel or we get them and 1-8 games, there would be no refund.

We know these times can be unpredictable, but we are in this together and it is our goal as in all years passed, to teach these kids to love the game of football. We appreciate your patience as we work together to make this season one to remember!

**2020 Football season is currently scheduled to be open. In the event of a natural disaster or pandemic, things are subject to change, per School, Mayor and Government request.**

W.L. Moore Combine July 18, 2020, if needed, it may be cancelled this year to prevent issues with Covid-19 or any other concerns.

Teams are declared July 22, 2020, I will contact coaches at this point to make the final decision on how many teams per grade.
